With record snowfalls, along with frigid temperatures in the Northeast, Southeast and Midwest, the U.S. Labor Department’s of Occupational Safety and Health Administration (OSHA) is urging all those involved in snow removal and cleanup to take precautions, and focus on safety.
Workers performing snow removal operations may be exposed to serious hazards. These include slips and falls while walking on snow and ice, falls from roofs and roof edges, through skylights, or from aerial ladders and lifts.
Those working outdoors may also be at risk of cold stress, including first responders who are on duty for long periods of time. Anyone working outside for prolonged periods may experience cold stress with mild symptoms, such as shivering while remaining alert.
Moderate to severe symptoms include shivering stops, confusion, slurred speech, heart rate/breathing slowness, and loss of consciousness. When the body is unable to warm itself, serious cold-related injuries may occur, such as frostbite.

For the majority of staffing companies, the answer is YES. Most staffing companies are required to have workers’ comp, no matter the number of employees. Workers’ compensation is governed by state. Meaning, many aspects of workers’ comp requirements will vary from state to state.
The following states have exceptions to the blanket statement that workers’ comp is always required:
- Alabama: Required after the fourth employee.
- Florida: Required after the fourth employee. However, construction businesses are required to always carry the insurance.
- Georgia: Required after the third employee.
- Michigan: Required once one employee is hired and works 35 hours a week for at least 13 weeks during the previous 52 weeks. Or it is required after the third employee.
- Mississippi: Required after the fifth employee.
- Missouri: Required after the fifth employee. However, contractors with just one employee must be covered.
- New Mexico: Required after the third employee. However, construction businesses are required to always carry the insurance.
- North Carolina: Required after the third employee.
- South Carolina: Required after the fourth employee.
- Tennessee: Required after the fifth employee, unless in the construction business or trades. These businesses are always required to carry insurance, in fact, owners are also required to carry coverage on themselves or be listed on the exemption registry.
- Virginia: Required after the third employee.
- Wisconsin: Required after the third employee.
- Texas: The insurance is not required.

I find many staffing companies turn to their General Liability agent for their workers compensation solution. Unfortunately, most G/L Agents do not know staffing work comp insurance very well, and often propose a State Fund solution for their staffing client. While the State Fund may be the “easy solution” for the Agent, it is often more expensive than other comp options- which require greater expertise of the staffing business and staffing work comp market.
As a former owner of a large staffing company that employed over 20,000 employees per year (and operated in 35 States,) I know that selecting the right work comp program is critical to making money in staffing– especially when profit margins are shrinking fairly regularly.
