Last week an 8M AZ and PA staffing company contacted Work Comp Staffing Solutions with a big workers compensation insurance problem. His workers compensation insurance carrier, Dallas National, had non renewed them and the State Funds were their only possible solution to stay in business. Unfortunately this meant that they needed 150K for a premium deposit within a week to secure the State Fund/ Assigned Risk Pool policies, before the workers compensation non renewal went into effect and they lost their workers compensation coverage. This would have probably put the staffing company out of business.
Work Comp Staffing Solutions was able to arrange for a nationwide Professional Employer Organization (PEO) to provide coverage to the staffing company within 72 hours so that they did not have to make the 150K premium deposit. In fact, the PEO solution did not require any premium deposit, which allowed the staffing company to keep their cash, and invest it back into their business to keep growing.
If you are still using the State Funds/ Assigned Risk Pools for your workers compensation coverage, you probably are paying higher rates than your competitors who use a PEO, and you are most certainly paying higher premium deposits. And of course your workers compensation fees are not being leveraged, so that you receive other back office software and human resource services that a PEO uniquely provides.

(Warning – this article is rated R)
This vignette about workers compensation insurance and unemployment fraud in Spain is almost too unbelievable. Below is the link to the article that will make you cringe, laugh, and cry — almost all at the same time

So if you think the US workers compensation system has its problems, just be grateful you are not an employer in Spain.
Remember if you are insured through a State Fund, you should look at utilizing a Professional Employer Organization (PEO) which can usually offer you better workers compensation rates and always offer much greater back office value for your money. I Would Hate to See The NFL’s Workers Compensation Rates After This Lawsuit……
California law allows NFL players to make a claim in California if they have played at least one game in the state. The plaintiffs argue that the arbitration award violates California and federal law and public policy by waiving their ability to seek workers comp in California, records show.
U.S. District Court Judge William H. Alsup ordered the three cases to be consolidated on March 13, court records show.
The NFL Management Council and the four NFL teams filed a counter suit on March 8 asking the court to require the players to file any workers comp claims in the state specified by their respective player contracts, records show.
The California comp lawsuits are part of several claims being made against the NFL by former players seeking compensation for injuries suffered on the field. At least 2,400 former players have sued the league over neurological and cognitive problems that they allege were caused by football-related head injuries.
Most of the concussion-related cases have been consolidated into multi district litigation in the U.S. District Court in Philadelphia. The NFL is expected to use an exclusive remedy defense in those lawsuits

While your staffing and contract employees probably do not wear football helmets on the job, you can see that workers compensation insurance is a priority in all businesses- even in the NFL.
Call us at 202-302-1212 to discuss how how we can offer you a lower priced workers compensation insurance program using a Professional Employer Organization (PEO.) Also please visit us at www.StaffingCompSolutions.com. Finally, given the complexity of these legal claims, perhaps the NFL owners are wishing they had used a PEO as a human resource and workers compensation partner!

When I owned my own multi state, 15K+ employee staffing company for 16 years, I often had discussions with my Professional Employer Organization (PEO) workers compensation risk management specialist about how I could control my workers compensation insurance costs. My PEO representative would remind me that the easiest and most direct way to lower my premiums, was to make sure that an injured worker is offered light duty assignments as soon as they get the green light from the medical doctor treating their injury.
I followed that advice and always maintained a very low mod. Below is a GREAT article about best practices for using Light Duty effectively.

After you have had a chance to review this article, let’s talk about other ways to reduce your workers compensation insurance and back office costs by partnering with a Professional Employer Organization (PEO)

While it is hard to generalize from one legal case, this one may help you to understand why partnering with a Professional Employer Organization (PEO) can save you time and money.
A Customer Service representative sued her employer after she was fired for having anxiety attacks which forced her to take time away from the job. The employee was fired after taking a few days off without telling the employer. She was subsequently awarded 16M because the (California) court felt she earned this amount in damages (please do not ask me to explain this amount) Actually she was awarded only 5.1M, but the court added treble damages so the total was 21M. See this case/link below
http://www.swrnn.com/2013/02/15/los-angeles-woman-fired-for-having-panic-attacks-awarded-21-7-million/
The take away from this story is two fold. First California can be a very expensive state to employ people, Second, employing people these days without the use of a human resource specialist like a PEO is inviting trouble.
Had the employer been using a Professional Employer Organization (PEO) they may not have made this personnel mistake, and more importantly, certainly would have had a qualified human resource/ legal partner to help deal with the aftermath of this management decision.
Please feel free to contact Work Comp Staffing Solutions at 202-302-1212 to discuss your PEO needs and how you can get a worker’s compensation quote. Also visit us at www.StaffingCompSolutions.com to learn more about PEO’s and other workers compensation insurance solutions.

I speak to dozens of staffing company owners each month. All size companies and all niches. Almost all of them are seeing their payroll costs increasing and are not sure what to do about them. There are 3 reasons that this is happening now:
- Increased healthcare costs
- Higher workers compensation insurance rates
- Increased state unemployment rates
As a former staffing owner, I know the last thing I ever wanted to do was to talk about having to increase my prices to a client. But as an industry, we are at that “tipping point” where workers compensation and other key payroll costs like Obamacare and unemployment costs are forcing staffing owners to have that tough conversation about raising prices.
Having managed many of these “sensitive ” client conversations successfully in the past, I have found some great ways to delicately talk about pricing issues- especially when it comes to workers compensation insurance rates and overall payroll costs. The key is to use hard data to reflect what is going on in the market place.
Below is a good article with hard data describing the trends for workers compensation insurance rates.
