Sometimes staffing companies can only get workers compensation through the State Funds. Both private carriers and Professional Employer Organizations (PEO’s) may not be willing to provide workers compensation coverage. But the staffing company still wants all the great human resources and payroll management services that PEO’s provide like:
- Payroll and workers compensation administration and management
- Payroll tax filings and W-2’s
- Health care benefit administration including the new Affordable Care Act.
- Human Resource functions.
The Administrative Service Organization will perform all these functions for the staffing company. The employees are 100% the staffing companies, and there is not a “co employment relationship” with the employees like with a PEO. March was a very busy month for Work Comp Staffing Solutions. We helped 6 diverse staffing companies partner with Professional Employer Organizations (PEO’s.)
Success #1. 2M staffing company in Maryland had been cancelled by their current carrier and needed workers compensation insurance to service their current clients, and 1M in immediate new business. All their codes were light industrial with a focus on mail room positions; and they had a 1.6 mod!
Success #2. New staffing company in California. This company places medical professionals all through Northern California and could not wait the 6 month’s that it usually takes for the California State Fund to process their paperwork. We found them a PEO to partner within a week, as well as payroll funding company, so they were ready to do business.

I Would Hate to See The NFL’s Workers Compensation Rates After This Lawsuit……
California law allows NFL players to make a claim in California if they have played at least one game in the state. The plaintiffs argue that the arbitration award violates California and federal law and public policy by waiving their ability to seek workers comp in California, records show.
U.S. District Court Judge William H. Alsup ordered the three cases to be consolidated on March 13, court records show.
The NFL Management Council and the four NFL teams filed a counter suit on March 8 asking the court to require the players to file any workers comp claims in the state specified by their respective player contracts, records show.
The California comp lawsuits are part of several claims being made against the NFL by former players seeking compensation for injuries suffered on the field. At least 2,400 former players have sued the league over neurological and cognitive problems that they allege were caused by football-related head injuries.
Most of the concussion-related cases have been consolidated into multi district litigation in the U.S. District Court in Philadelphia. The NFL is expected to use an exclusive remedy defense in those lawsuits

When I owned my own multi state, 15K+ employee staffing company for 16 years, I often had discussions with my Professional Employer Organization (PEO) workers compensation risk management specialist about how I could control my workers compensation insurance costs. My PEO representative would remind me that the easiest and most direct way to lower my premiums, was to make sure that an injured worker is offered light duty assignments as soon as they get the green light from the medical doctor treating their injury.
