This question arises when the staffing company needs to keep payroll in-house, or with an existing 3rd party payroll processor. How Long Do I Need To Keep Workers Compensation Injury Records?

As President of Work Comp Staffing Solutions, the nation’s leading staffing work comp brokerage, I am often asked by clients how long work comp records need to be kept. Unfortunately, there is no one answer since the regulations are state specific. Generally, workers’ compensation injuries fall under the auspices of two organizations: the state’s workers’ comp division and the U.S. Occupational and Safety Health Administration– OSHA.

While OSHA requires a minimum of five years (with some exceptions) each state is different.

Work Comp Fraud Does Not Pay

If you use a State Fund or Private Carrier Policy for your work comp program, it is critical that you report all your payroll during an audit.*

Aileen Ramirez of Quality Employment Services LLC found out the hard way about under reporting payroll during a California State audit. Ramirez under reported $2.8 million dollars of payroll over 2 years resulting in a loss to the State Fund of $525,253.58 in insurance premiums. She was charged as a felon and had to reimburse the State for that amount. She received 3 years probation and is now a felon.
