When I owned my own multi state, 25K+  employee staffing company for 16 years, I often had discussions with my Professional Employer Organization (PEO)  workers compensation risk management specialist about how I could control my workers compensation insurance costs. Cell Phone Use On The Job …. What Is Your Safety Policy?

One of my clients recently mentioned that his workers compensation rates were significantly increasing  because of an employee that experienced a major job related accident while texting on a staffing assignment.

Given that nearly everyone has a cell phone these days, I wondered how many of my clients had a specific policy about cell phone usage while on the temporary assignment?

Shopping for a Professional Employer Organization (PEO)

As more and more staffing companies use a PEO to reduce their soaring workers compensation insurance rates, it is important that they thoroughly review the PEO’s credentials with an experienced staffing PEO broker.
Here are some simple guidelines  to follow with your staffing-PEO broker.

  1. Make sure the PEO is  reputable and a  legally insured PEO.
  2. Confirm the authenticity  of the PEO’s certificate of insurance.
  3. Find out what services the PEO will offer. Meet the people who provide the services.
  4. Check the company’s references. Make sure they are paying payroll taxes.
  5. Determine if the company is a member of the  National Association of
    Professional Employer Organizations (NAPEO.)
  6. How does the PEO cover ACA benefits? Is it licensed in particular states? – Are they  self insured? – Who is their carrier?
  7. Review your liability in the service agreement.

Who is Responsible When a Temporary Employee Gets Hurt On The Job?

Many of my staffing clients  are frustrated  when they tell me that THEIR clients do not feel responsible when a temporary employee gets hurt at their location. But according to very specific guidelines from OSHA, THEIR  client certainly bares some of the responsibility in this situation.  This is a fact that is unfortunately lost on many of their clients. As a result, some staffing client companies do not always make sure that the temporary workers perform their jobs in a safe environment.
