As more and more staffing companies use a PEO to reduce their soaring workers compensation insurance rates, it is important that they thoroughly review the PEO’s credentials with an experienced staffing PEO broker.
Here are some simple guidelines to follow with your staffing-PEO broker.
- Make sure the PEO is reputable and a legally insured PEO.

Many of my staffing clients are frustrated when they tell me that THEIR clients do not feel responsible when a temporary employee gets hurt at their location. But according to very specific guidelines from OSHA, THEIR client certainly bares some of the responsibility in this situation. This is a fact that is unfortunately lost on many of their clients. As a result, some staffing client companies do not always make sure that the temporary workers perform their jobs in a safe environment.

In the most recent edition of Staffing Success from the American Staffing Association, there was an excellent article explaining the application of the new ACA laws for the staffing industry. The authors discussed the significant amount of new paperwork and administration associated with correctly applying this new law to staffing companies.
These increased administrative responsibilities (and liabilities) makes the value equation for using a Professional Employer Organization (PEO) as your back office/workers compensation solution that much more significant.

(Elves complain of unsafe working environment)
It was only a matter of time before the the Federal Government/OSHA got involved in Santa’s business. To be sure, Santa’s employment lawyers will probably argue that the North Pole (where the toys are manufactured) is not covered by US labor law. But of course, the recipients of the toys are largely the well behaved kids in America, hence justifying the Federal government’s/ OSHA involvement.

Reducing Work Comp Rates

Over the last 18 months, we have witnessed insurance companies becoming much more selective in the staffing industry with respect to who they underwrite for comp. One reason for this change is that since January, the NCCI reformed their formulas for calculating mod rates (first time in 20 years.) Now, if a staffing company is not best in class from a safety perspective, the carrier will usually not under write a policy or will only do so with VERY high deductibles.
